Lyft Car Accident Insurance Coverage

Ride sharing services like Lyft have become incredibly popular in the past few years, with some people relying upon them as their primary method of transportation. The rising popularity has increased the demand for these services and in turn has increased the number of drivers who want to make money driving for Lyft and other ride sharing apps.

But like anything, there is bad that comes with the good because more drivers on the road means a greater potential for an accident. Because of this fact, it is important to understand the scope of Lyft insurance available if you are in a Lyft car accident.

Breakdown of Lyft Insurance Coverage

1. Liability Insurance Coverage for a Lyft Car Accident While In Route

Similar to the insurance coverage provided by Uber, Lyft has one million dollars worth of liability coverage if a Lyft driver causes an accident while he or she is signed into the app. This includes the time while the driver is going to get a fare and the time between when a fare is picked up and subsequently dropped off.

Although it is certainly not typical, some drivers have commercial insurance or personal insurance that allows for ridesharing coverage (most policies exclude this coverage). In those instances, the driver’s policy is the primary policy and the Lyft policy is an excess policy on top of it. To explain this with an example, if the driver’s policy has $500,000 worth of coverage and you have $1,500,000 in damages, the driver’s policy would pay the first $500,000 and then the Lyft policy would pay the remaining $1,000,000.

2. Liability Insurance Coverage for a Lyft Car Accident While Logged Into the App

When the a Lyft driver is signed into the app (i.e., is available to pick up a passenger but not yet on the way), Lyft provides liability insurance with limits of $50,000 per person but only up to a total of $100,000 per accident. This means that if there are three people injured in a Lyft car accident, Lyft’s insurance policy would pay no more than $50,000 to any one of those three people but no more than $100,000 to all three of them in total.

3. Liability Insurance Coverage for a Lyft Car Accident While Not Yet Logged Into the App

If you get into an accident with a Lyft driver who is not logged into the app, the driver’s personal insurance would be the only available coverage. This means that the available limits could be as low as $15,000 per person up to a total of $30,000 for all people involved in an accident.

4. Uninsured/Underinsured motorist (UM) Insurance Coverage for a Lyft Car Accident

Uninsured/underinsured motorist (UM) coverage applies when the driver who causes an accident either does not have liability coverage or does not have enough liability coverage to cover all of the damages that an injured person suffers. Getting in an accident with an uninsured or underinsured driver is a terrible situation, but thankfully Lyft has a $1,000,000 UM policy for Louisiana car accidents. However, this insurance only applies if the accident happens when a Lyft driver is on the way to pick up a fare or if he or she has a fare in the car.

It is important to remember that this insurance coverage can apply to both the passenger and the Lyft driver. So, if there is a Lyft car accident caused by the negligence of an uninsured or underinsured driver, both the passenger and the Lyft driver could make a claim on the Lyft UM policy.

For the passenger, it gives them an additional way to recover because they could take advantage of the policy from the other driver’s vehicle, their own UM policy  (if they have one), and the Lyft UM policy. Being a passenger who gets injured allows for an injury victim to stack UM coverage (click here to learn more about the anti-stacking law in Louisiana).
